BUYER: the person who places the order using the name and e-mail address on their account.
2. Subject
This agreement governs the sale and delivery of a licence for the GP Newsdesk WordPress theme (the "Product") ordered electronically, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
3. The Product
The Product is digital and has no physical component: a WordPress theme, its companion plugin, documentation, and the licence key that gives access to them.
- A licence may be used on an unlimited number of WordPress sites: your own sites and sites you build for your clients. Sharing the licence key or downloaded packages with third parties, reselling them, distributing them on GPL clubs or subscription sites, or bundling them with hosting plans is not allowed. Unusual use (e.g. many different domains in a short time) may be reviewed; on a breach the licence's update, download and support rights end without refund. Sites already installed keep working.
- The licence is lifetime; updates are included for as long as the licence is valid.
- When the site moves to a new domain, the stored licence key is activated on the new address automatically; nothing else is needed.
4. Price and payment
The price including taxes, and the currency, is shown on the checkout page and is the price valid at the time you confirm the order. Payment is taken by card through Stripe; we never see or store your card details. Launch campaign prices apply only until the stated end date.
5. Delivery
Delivery is electronic and immediate once payment is confirmed: the licence key is e-mailed to you and shown in your account, where you can download the theme files. There is no shipping.
6. Right of withdrawal
Consumers normally have a 14-day right of withdrawal in distance contracts. However, under Article 15(1)(ğ) of the Turkish Distance Contracts Regulation, there is no right of withdrawal for contracts for services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer.
The Buyer acknowledges that the Product is delivered immediately after payment, that they were clearly informed before ordering that the statutory right of withdrawal therefore ends, and gives explicit consent to performance beginning immediately.
This does not limit the Buyer's other statutory rights, for example in case of a defective product.
7. Refunds
As the Product is an intangible good delivered right after payment and the Seller offers no voluntary money-back guarantee, payments are not refunded once completed. The Buyer's rights under section 9 and the law remain if the Product does not work as described.
8. Licence and intellectual property
All intellectual property rights belong to the Seller or its licensors. The Buyer may use the Product on the licensed site(s) only; copying, redistributing, reselling or sharing the licence key is prohibited. Third-party and open-source components (for example under GPL) remain under their own licences. See the Terms of Use.
9. Defects and support
If the Product does not work as described, open a support ticket and we will work to fix it. Your statutory rights remain unaffected.
10. Personal data
Personal data is processed as described in the Privacy Notice (KVKK).
11. Disputes
Within the monetary limits announced each year by the Ministry of Trade, Consumer Arbitration Committees at the Buyer's or Seller's place of residence are competent; above those limits, Consumer Courts.
12. Effect
The Buyer confirms electronically, before ordering, that they have read this agreement and the pre-contract information. The agreement takes effect when the order is confirmed and payment is completed.
